Can I Get a Car Loan While I’m Still Bankrupt?

It may be possible.

Many customers assume that declaring bankruptcy automatically prevents them from financing another vehicle until they’ve been discharged.

That’s not something we can say is universally true based on our experience arranging automotive financing.

Some lenders or approval situations may require discharge before they’ll consider an application.

However, Pacific Nations has also worked with customers who obtained vehicle financing while their bankruptcy was still active.

The outcome depends on the individual application, the lender reviewing it and whether the transaction meets that lender’s requirements.

What You’ve Done Since Filing for Bankruptcy Matters

Bankruptcy tells a lender that significant financial difficulties occurred in the past.

But when someone applies for new vehicle financing, lenders can also look at what’s happened since the bankruptcy began.

From what we’ve seen working with customers in bankruptcy, staying current with the obligations you’re required to maintain and avoiding new derogatory credit can be particularly important.

Someone who has gone through financial difficulty and then consistently stayed on top of their obligations presents a different situation from someone who begins accumulating new missed payments or unpaid obligations afterward.

You can’t change what happened before the bankruptcy.

What you can control is how you manage your financial obligations going forward.

You May Need Information From Your Trustee

If you’re applying for vehicle financing while your bankruptcy is still active, a lender may require additional information relating to the bankruptcy.

Depending on the lender and your individual circumstances, this can include documentation or confirmation from your Licensed Insolvency Trustee.

If a lender requires additional documentation, our finance team can explain what is being requested so you know what you’ll need to obtain from your trustee.

Do I Have to Be Discharged From Bankruptcy First?

Not in every situation.

We’ve seen both outcomes.

Some lenders or individual approvals may require a customer to be discharged before new vehicle financing can proceed.

We’ve also seen customers obtain approvals while their bankruptcy was still active.

Because lender requirements and individual financial situations differ, there isn’t a responsible way to tell every customer in bankruptcy that they either will or won’t qualify without reviewing their actual application.

That’s why we prefer to look at the customer’s current circumstances rather than making assumptions based solely on the bankruptcy.

What Can Affect a Vehicle Financing Approval During Bankruptcy?

There isn’t one single factor that determines whether someone in bankruptcy will qualify for a vehicle loan.

A lender may consider a combination of information including:

  • Your current income
  • Employment and income stability
  • Your current financial obligations
  • The status of your bankruptcy
  • Your financial history since filing
  • Any new derogatory credit
  • Documentation available from your trustee
  • The vehicle being financed
  • The amount being financed
  • A trade-in, if applicable
  • A down payment, if applicable
  • The individual lender’s approval criteria

Not every automotive lender evaluates these situations in exactly the same way.

What If I’ve Already Been Discharged From Bankruptcy?

If you’ve already been discharged, you can absolutely explore vehicle financing with Pacific Nations.

A previous bankruptcy remains part of your credit history for a period of time, so being discharged doesn’t mean lenders will simply ignore it.

However, discharge is an important change in your financial circumstances, and some financing options that weren’t available during an active bankruptcy may potentially become available afterward.

Our finance team will work with your circumstances at the time you apply and determine what options may be available through our lender network.

Can Financing a Vehicle Help Rebuild Credit After Bankruptcy?

A vehicle loan creates a new credit obligation, so it should first and foremost be a payment that fits comfortably within your budget.

If you obtain financing, making your required vehicle payments on time gives you an opportunity to establish new payment history after bankruptcy.

We don’t recommend choosing a vehicle simply for the purpose of “building credit.” The vehicle and payment still need to make sense for your actual transportation needs and financial situation.

Should I Get Pre-Approved Before Choosing a Vehicle?

You don’t have to, but it can be particularly useful when you’re applying for financing during or after bankruptcy.

A pre-approval gives our finance team an opportunity to determine what lender options and approval parameters may actually be available before you become committed to a particular vehicle.

That can also help our sales team identify vehicles that fit both your transportation needs and the financing parameters we’re working with.

Instead of estimating payments using an assumed interest rate, we can discuss vehicles based on actual financing information once an approval is available.

Yes.
